Partner Visas for Permanent Residents and Citizens

Partner Visas for Permanent Residents and Citizens

The following section outlines the relevant arrangements for partners of permanent residents and citizens, as well as partners of temporary visa holders in Australia.

A. Partner Visas for Permanent Residents and Citizens

Partner Visa (Subclasses 309/100)

These visas are available to eligible spouses or de facto partners of Australian citizens, Australian permanent residents, or eligible New Zealand citizens.

The Subclass 309 visa is the temporary stage of the offshore Partner visa pathway. Eligible applicants may subsequently be considered for the permanent Subclass 100 visa, generally after the relevant two-year assessment period from the date of the original application, subject to applicable requirements and exceptions.

Applicants must provide evidence that their relationship is genuine and continuing. Immigration authorities may conduct detailed assessments of the relationship and request additional supporting documentation.

B. Partner Visas for Temporary Visa Holders

The original Persian text refers to Subclasses 820/801 as visas for partners of temporary visa holders. This classification requires clarification.

Partner Visa (Subclasses 820/801)

These visas are generally for eligible spouses or de facto partners of Australian citizens, Australian permanent residents, or eligible New Zealand citizens who apply while in Australia, subject to the relevant requirements.

The Subclass 820 visa is the temporary stage, while the Subclass 801 visa is the permanent stage. Eligible applicants may progress to permanent residency after the applicable assessment period, subject to the relevant criteria.

Important: The spouse or partner of an Australian temporary visa holder does not automatically qualify for a Subclass 820/801 Partner visa. Depending on the primary visa holder’s visa subclass, the partner may instead be eligible to apply as a subsequent entrant or dependent under that visa category. The applicable conditions must be checked for each visa type.
